Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the Yaride platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

These Terms constitute a legally binding agreement between you and Yaride. We reserve the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance.

2. Eligibility

To use the Platform you must:

• Be at least 18 years of age
• Hold a valid Jamaican driver's licence (or international equivalent accepted in Jamaica)
• Complete identity verification as required by Yaride
• Not be prohibited from using the Platform under applicable law

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at info@getyaride.com if you suspect unauthorised access to your account.

You agree to provide accurate, current, and complete information and to keep it up to date. Yaride reserves the right to suspend or terminate accounts that provide false information.

4. Renter Responsibilities

• Renters must hold a valid driver's licence for the duration of the rental
• Vehicles must be used only for lawful purposes within Jamaica
• Renters must return the vehicle at the agreed time, date, and location
• Renters are responsible for fuel, tolls, and parking during the rental period
• Smoking, transporting illegal substances, or sub-letting the vehicle is strictly prohibited
• Any damage, accident, or traffic violation must be reported to Yaride immediately

5. Car Owner Responsibilities

• Owners must ensure their vehicle is roadworthy, registered, and has a valid fitness certificate
• Vehicle listings must accurately represent the condition, features, and availability of the car
• Owners must maintain adequate insurance coverage as required under Jamaican law
• Owners must honour confirmed bookings; repeated cancellations may result in account suspension
• Owners are responsible for collecting and remitting any applicable taxes on rental income

6. Payments and Fees

All payments are processed through the Platform. Renters are charged at the time of booking. Yaride retains a service fee from each transaction; the remainder is disbursed to the car owner after the rental is completed.

Cancellation fees may apply depending on how far in advance the cancellation is made. Full details are displayed before you confirm a booking.

7. Insurance and Liability

Yaride provides basic insurance coverage through its partner insurer for rentals made through the Platform. This coverage does not replace the owner's own vehicle insurance and has specific exclusions. Details of coverage are provided within the app before each booking.

Yaride acts as a marketplace and is not a party to the rental agreement between owner and renter. Yaride is not liable for personal injury, property damage, or other losses arising from the use of vehicles booked through the Platform beyond what is covered by the insurance policy.

8. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Post false, misleading, or fraudulent content
• Circumvent the Platform to arrange off-platform transactions
• Harass, threaten, or abuse other users
• Attempt to gain unauthorised access to any part of the Platform
• Use automated tools to scrape or extract data from the Platform

9. Termination

Yaride may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct that endangers other users or the Platform. You may delete your account at any time through the app settings.

10. Governing Law

These Terms are governed by the laws of Jamaica. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Jamaica.
